All the work under this Contract shall be done in accordance with the Plans and Specifications. The Engineer will determine the amount, quality, acceptability and fitness of the several kinds of work and materials which are to be paid for hereunder and will decide all questions of fact, but not of law, which may arise as to the fulfillment of the contract on the part of the Contractor. The Engineer's determination and decision thereon shall be final and conclusive and such determination and decision, in case any questions of fact arise, shall be a condition precedent to the right of the Contractor to receive any monies hereunder. Each bidder is required to furnish with its proposal, a Bid Guaranty and Contract Bond in accordance with Section 153.54 through 153.571 of the Ohio Revised Code. Bid security, furnished in Bond form, shall be issued by a surety company or corporation licensed in the State of Ohio in the full amount of one hundred percent (100%) of the bid amount. A 100% satisfactory performance and payment bond shall be required of the successful bidder. All bidders must comply with the prevailing wage rates on Public Improvements in Hamilton County and the City of Norwood as determined by the Ohio Department of Commerce, Bureau of Wage & Hour Administration. The City of Norwood reserves the right to reject any or all bids, or to accept or reject any part thereof. Bid note: Each bid must be submitted in a sealed envelope plainly marked on the outside with the name of the bidder, his address, and the name of the project for which the bid is submitted. Each bid must contain the full name of the party or parties submitting the same and all persons interested therein.
