Mid-Dakota Rural Water System, Inc. | Contract 4-7 Schedule 1 System Improvements The Project consists of constructing approximately 139,150 feet of 3-inch, 6-inch, 8-inch and 16-inch diameter gasketed joint polyvinyl chloride pipeline, connections to existing pipelines, cleanouts, road and stream crossings and all appurtenances required by the Project Drawings, Specifications, and Contract Documents. The project is located in Hughes, Potter and Sully Counties in South Dakota. A Bid must be accompanied by Bid security made payable to Owner in the amount of ten (10) percent of Bidder's maximum Bid Price (determined by adding the base bid and all alternates) in the form of a Bid (on the form included in the Bidding Documents) issued by a surety the requirements of Paragraphs 6.01 and 6.02 of the General Condition or by a certified check or bank money order payable to the Owner in the amount of five (5) percent of the Bidders maximum bid price. Bidders on this work will be required to comply with the Presidents Executive Order Nos. 11246 as amended, 11458, 11518, and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications. This project may be partially funded using American Rescue Plan Act (ARPA) funds. As a condition of the ARPA funding guidelines, the Contractor shall meet the following requirements: 1. Contractors are required to employ a preference for the purchase, acquisition, or use of goods, products, or materials produced in the United States (including but not limited to iron, aluminum, steel, cement, and other manufactured products.) The Contractor shall provide documentation of such efforts to purchase goods, products, or materials produced in the United States upon request. 2. The Contractor shall make a good faith effort to utilize Disadvantaged Business Enterprises (DBE) and/or Minority Business Enterprises (MBE) and shall provide documentation of the effort to solicit bids from qualified entities upon request. Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order No. 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women's Business Enterprises (WBE) are explained in the contract documents. The goal for MBE is 1% of the total dollar value of the project. The goal for WBE is 4% of the total dollar value of the project. Owner reserves the right to reject any and all Bids. Award, if made, shall be to the lowest responsible Bidder whose Bid is responsive to the invitation and is most advantageous to the Owner, in its sole and exclusive discretion, price and other factors considered. The Owner may reject a Bid as nonresponsive if the prices bid are materially unbalanced between the line items or subline items. A Bid is materially unbalanced when it is based on prices significantly less than the cost for some work and prices which are significantly overstated in relation to cost for other work, and if there is a reasonable doubt that the bid will result in the lowest overall cost to the Owner even though it may be the low evaluated bid, or if it is so unbalanced as to be tantamount to allowing advance . The Owner also reserved the right to waive all information not involving price, time or changes in the Goods and Special Services, and to negotiate contract terms with Successful Bidder. Bid security shall be furnished in accordance with the Instructions to Bidders.
