Lift Station and Utility Extension The work for which bids are asked includes the following: Rock Excavation 3600 CY Bituminous Pavement (All Mixes) 34 TON Sanitary Sewer Gravity Main 2655 LF Sanitary Sewer Forcemain 1742 LF Sanitary Sewer Laterals 971 LF Sanitary Sewer Structures 8 EA Sanitary Sewer Lift Station 1 EA Water Main 1315 LF Water Laterals 290 LF Hydrants 3 EA The anticipated substantial completion date is August 9, 2024 and final completion date is August 30, 2024. This project has a fixed budget and required phasing of work. Refer to Division S for details on phasing requirements. No proposal will be accepted unless accompanied by a certified check or bid bond equal to at least 5% of the amount bid, payable to the OWNER as a guarantee that, if the bid is accepted, the bidder will execute and file the proper contract and bond within 15 days after the award of the contract. BIDDER is required to deliver the original certified check or bid bond within the 72 hours of bid opening to MSA Professional Services, Inc., Attn: Jon Loye, 332 W. Superior Street, Suite 600, Duluth, MN 55802. The certified check or bid bond will be returned to the bidder as soon as the contract is signed, and if after 15 days the bidder shall fail to do so, the certified check or bid bond shall be forfeited to the OWNER as liquidated damages. No bid may be withdrawn within 60 days after the actual date of the opening thereof. Non-Discrimination. The Public Entity agrees to not engage in discriminatory employment practices regarding the Project, or operation or management of the Real Property and, if applicable, Facility, and it shall, with respect to such activities, fully comply with all of the provisions contained in Chapters 363A and 181 of the Minnesota Statutes that exist as of the date of this Agreement and as such may subsequently be amended, modified or replaced from time to time. Worker's Compensation. The Public Entity agrees to comply with all of the provisions relating to worker's compensation contained in Minn. Stat. 176.181, subd. 2 and 176.182, as they may be amended, modified or replaced from time to time, with respect to the Project and the operation or management of the Real Property and, if applicable, Facility. Prevailing Wages. The Public Entity agrees to comply with all of the applicable provisions contained in Chapter 177 of the Minnesota Statutes, and specifically those provisions contained in Minn. Stat. 177.41 through 177.435, as they may be amended, modified or replaced from time to time with respect to the Project and the operation of the Governmental Program on or in the Real Property and, if applicable, Facility. By agreeing to this provision, the Public Entity is not acknowledging or agreeing that the cited provisions apply to the Project or the operation of the Governmental Program on or in the Real Property and, if applicable, Facility. Six Good Faith Efforts. Prime Contractors must follow and document their good faith efforts in both the procurement process and by complying with specific contract language. The Six Good Faith Efforts in the project technical specification are to ensure that DBEs have the opportunity to participate in procurements, by increasing DBE awareness of procurement efforts, and outreach. In addition the successful Bidder will be obligated to enter into and comply with both the Responsible Contractor Requirement (Chapter 253 [16C.285] and the requirements of a Project labor Agreement between the Owner and the Duluth Building and Construction Trades Council. OWNER reserves the right to waive any informalities or to reject any or all bids.
