Bidders shall refer any questions regarding this bid in writing via letter or fax to: Denis Walsh, PE, Monmouth County Division of Engineering & Traffic Safety, Hall of Records Annex, 1 East Main Street, Freehold NJ 07728 or by fax at 732-431-7765 Bids must be made on standard RFB forms in the manner designated and required by the specifications. The work to be performed under this Contract consists of securing NJDEP Dam Safety Lake Lower permit to implement concrete repairs and install scour countermeasures at the existing Englishtown Dam spillway. Work shall include Type 1, Type 2 and Type 3 concrete repairs to the walls and spillway of the dam, crack repairs as needed, and installation of Grout Filled Fabriform Fabric concrete bags or approved equal. It shall include building and maintaining all necessary temporary impounding works, cofferdams, check dams, channels, flumes, ditches and diversions; furnishing, installing and operating all necessary pumps, piping and other facilities and equipment water through the construction site while construction is in progress; preparation and submission of a control of water plan; removing all such temporary works and equipment after they have served their purposes; all costs associated with applying for, and obtaining, a water lowering permit, or any other associated permits, from the NJ Division of Fish and Wildlife. The contractor shall review available data regarding reservoirs and spillway flow and level conditions at the site before submitting a control of water plan to the owner/engineer. Available information may be obtained from the owner. The Contractor shall verify water surface elevations shown on the contract documents when planning their work. The Contractor is warned that groundwater, runoff and other site conditions may be highly variable and difficult to accurately predict. Previous analyses and evaluations may or may not provide satisfactory information to the Contractor for developing a control of water plan. It is solely the Contractor's responsibility to evaluate the applicability of the available information and to obtain or develop additional information as a basis for development of the Contractor's control of water plan. The Contractor shall furnish to the owner/engineer in writing, his complete plan for controlling surface water, storm water runoff flow and ground water around the work as necessary, for review and comment within 14 calendar days following the notice to proceed. Review of this plan by the owner/engineer will not relieve the Contractor of his responsibility for completing the work as specified. The Contractor is further advised that upon award of the contract by the Board, the Contractor will be notified of such award, and of the intent of the County to execute a contract for this work, by the County Engineer. The Contractor is required and bound by these specifications to order all materials having significant lead times, specifically but not limited to concrete grout filled fabric bags, and to begin preparation of critical working drawings within 48 hours of such notice. Failure on the part of the Contractor not to comply with this condition may be considered a breach of contract and will result in the assessment if liquidated damages if said failure to order materials and prepare working drawings results in failure to complete on time. If for whatever reason a contract for this work is not executed between the County and the successful bidder, the County will pay the Contractor the actual invoiced cost of all materials ordered subsequent to award, provided that they satisfy the materials and fabrication specifications regarding same contained herein. This payment will be made upon delivery of these satisfactory materials to the project site in accordance with 109.06. The Contractor is advised that it is of the utmost importance that contract work be completed within the times frame specified in Subsection 108.10, and that the County shall consider time to be of the essence. The Contractor is advised to reconsider submission of a proposal for this project if they believe they cannot comply with the time restrictions set forth in these Special Provisions. The Contractor shall take all measures to ensure the critical equipment is onsite when needed. The attention of the Contractor is called to the presence of various utilities that require relocation and/or temporary support/protection during construction. Specifics regarding same are discussed further in Subsection 105.07 of the Special Provisions. The Contractor shall verify all underground utilities before construction. The work under this project includes all required labor, equipment, material, and other incidental and necessary work shown on the Construction Plan and as further described herein in accordance with the Standard Specifications for Road and Bridge Construction and these Special Provisions, or as directed by the RE. The Contractor is advised that he/she is responsible for all work under this Contract with the exception of the relocation of utility facilities and that no work is to be performed "by others". All utility facilities requiring relocation are to be relocated by the various utility companies. The Contractor will be responsible for coordination and scheduling of his/her work to assist the utility companies with their relocations, as well as providing temporary support and relocation for specific utilities as called for in the plans and these Special Provisions. Specifics regarding same are discussed further in Sections 105 and 201 of these Special Provisions. The work under this project includes all required labor, equipment, material, and other incidental and necessary work shown on the Construction Plan and as further described herein in accordance with the Standard Specifications for Road and Bridge Construction and these Special Provisions, or as directed by the RE.
