Each proposal is based upon a duration of one (1) year, together with one (1) consecutive one-year option, exercisable in the sole discretion of the Authority. No Bids shall be received other than at the time and place designated herein. Bids shall be hand delivered or received by the Authority by courier service (including but not limited to Fed Ex, UPS, DHL, etc.) (date and time recorded) Bids shall be handwritten on the forms furnished by the Authority in the Contract Documents, as that term is defined in the Contract referenced herein and prepared and submitted in the manner designated therein. The Work under this procurement shall include furnishing, without limitation, all labor, equipment, materials and all other items or services necessary and/or required for the performance of the INTERNAL INSTRUMENTATION AND SCADA, DAS AND CEMS MAINTENANCE, CALIBRATION AND REPAIR. The term of the contract shall be for a period anticipated to commence on January 1, 2024 and shall continue through December 31, 2024. A certified check, cashier's check or Bid Bond in the amount of ten percent (10%) of the Bid, as specified in the Bid submitted by the Bidder, but not in excess of $20,000.00, whichever is lower, must be submitted with the Bid as a guaranty that if a contract is awarded by the Authority, the Successful Bidder shall execute the Contract required by the Contract Documents. The surety or sureties issuing any Bid Bond as required by the Contract Documents shall be licensed and/or authorized to transact business in the State of New Jersey and shall be acceptable to the Authority. Contractor shall be required to comply with the requirements of the Law Against Discrimination, N.J.S.A. 10:5-31, et. seq. and the Equal Employment Opportunity and Affirmative Action Rules set forth at N.J.A.C. 17:27-1, et seq. and the Americans with Disabilities Act of 1990, 42 U.S.C. 12.101, et seq., as applicable. Additionally, a copy of the Business Registration Certificate issued by the New Jersey Department of Treasury, Division of Revenue, for the Bidder and any subcontractors, must be submitted prior to the award of the Contract in conformance with N.J.S.A. 52:32-44. The Successful Bidder, as that term is defined in the Contract, shall be required to comply with all provisions of the New Jersey Prevailing Wage Act, N.J.S.A. 34:11- 56.25, et seq., as applicable, and all other Applicable Laws. In the event that a potential bidder obtains the Contract Documents in any manner other than as specified herein, the Authority will not have the contact information of the potential bidder for purposes of issuing bid addenda, if any. The non-receipt of any addenda (in the event that any addenda are issued) and the failure of the bidder to acknowledge the receipt of any and all addenda at the time of bid shall be considered a fatal defect in such Bidder's submission and said Bid shall be immediately rejected. Therefore, if a potential bidder obtains the Bid Documents in any manner other than as specified herein, said Bidder shall promptly provide written notice to the Authority accordingly. Bids shall be prepared and submitted in the manner designated and shall also be accompanied by all information requested in the Contract Documents. The Authority expressly reserves the right to reject any and all Bids and/or to waive any informalities in accordance with the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.
