Cave Spring Road Improvements along Cave Spring Road. The Contract, if awarded, will be a not to exceed price based on unit prices bid. No bid may be withdrawn for a period of sixty (60) days after time has been called on the date of opening. Bids must be accompanied by a Bid Bond in an amount of not less than five percent (5%) of the base bid. All bonds must be signed or countersigned by a Georgia Resident Agent. A faithful Performance Bond in the amount of one hundred percent (100%) of the amount of the bid, and a Labor Materials Payment Bond in the amount of not less than the amount of said Bid, one hundred percent (100%) as provided by Georgia Code Section 23-1704 and 23-1705, shall be furnished by the successful bidders. The right is reserved to the Board of Commissioners of Polk County, Georgia to delay the award of the Contract for a period not to exceed ninety (90) days from the date of opening of bids, during which time bids shall remain open and not subject to withdrawal. The right is also reserved to the Board of Commissioners of Polk County to reject any and all bids and to waive any and all technicalities or informalities. Any contract executed pursuant to this notice shall be binding upon the Board of Commissioners of Polk County, Georgia as such, but will not create a liability expressed or implied, against any members of the Board of Commissioners of Polk County, the Chairman of the Board, or employee of Polk County, in his or her individual capacity. Time of Completion : 60 Dyas The Bidder further agrees to pay as liquidated damages the sum of $200.00
