The project involves a 2-year repair contract to perform MISCELLANEOUS PAVING AND RESTORATION REPAIR work for a period of 2 years. The contract is intended to provide the North Hudson Sewerage Authority (OWNER) with a repair program capable of being implemented to perform miscellaneous paving and restoration. The paving and restoration repair projects will be located in the Authority's service area in the City of Hoboken, City of Union City, Township of Weehawken, and Town of West New York, Hudson County, New Jersey. The CONTRACTOR shall be prepared to complete the work regardless of the size of the project for the unit prices bid. The contract will be awarded to the most responsible contractor with the lowest responsive bid for a model project as determined by the quantities included in the bid form. The CONTRACTOR shall be required to commence construction operations at each project site, as designated by the OWNER, within 10 days of the Notice to Proceed, as hereinafter prescribed in the Bidding Documents, for each individual project. When and where a project is identified for repair, the CONTRACTOR will be compensated for the work performed according to the unit prices, allowances, and lump sum prices submitted with the bid. Each project contract duration will be established based on the scope of work for the specific project as determined by the Authority. Upon Issuing Office's receipt of payment, printed Bidding Documents will be sent via the prospective Bidder's delivery method of choice; the shipping charge will depend on the shipping method chosen. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the prospective Bidder's date of receipt of the Bidding Documents. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including Addenda if any, obtained from sources other than the Issuing Office. If the Contract is awarded, no refunds will be given. If for any reason the Contract is not awarded, refunds will be made to bidders pursuant to N.J.S.A. 40A:11 24(b) when the ConA_,tract DocuA_,ments are returned in reasonable condition within 90 days of notice that the Contract has not been awarded. Bid security shall be furnished in accordance with the Instructions to Bidders. The Owner will evaluate bids and any award will be made to the lowest, responsive, responA_,sible bidder in accordance with N.J.S.A. 40A:11-6.1. A copy of N.J.S.A. 40A:11-6.1 is included in Section entitled Local Public Contract of this specification. The Owner reserves the right to reject any or all bids and to waive minor informaliA~,ties or irregularities in bids received. The qualification and reclassification of bidders will be subject to the statutory provisions contained in N.J.S.A. 40A:11-25 to 32 ("Local Public Contract Law"). A copy of N.J.S.A. 40A:11-25 to 32 is included in the Section entitled "Local Public Contract Law" of this specification. Bidders are required to comply with all relevant Federal and State Statutes, Rules and ReguA-'A-'laA-'tions including but not limited to the applicaable provisions of Title VI of the Civil Rights Act of 1964, as amended (42 USC 2000d 2000D 4A), the discrimination and affirmaA-'tive action proA-,viA-,sions of N.J.S.A. 10:2 1 through 10:2 4, the New Jersey Law against DisA-,criminaA-,tion, N.J.S.A. 10:5 1, et seq., the rules and regulations promulgated pursuant thereto, the State requireA-'ment for bidders to supply statements of ownership (N.J.S.A. 52:25 24.2) and the State requireA-'ment for submisA-'sion of the names and addresses of certain subcontractors (N.J.S.A. 40A:11 16). The Contract or Subcontract will be subject to regulations contained in Local Public Contract Law, Department of Labor Current Wage Rate Determination, Prevailing Wage Act, Contract Work Hours and Safety Standard Act, Copland Act, Davis Bacon Act, Buy American Clause, and Debarment and Suspension. Pursuant to P.L. 2004, c.57 (N.J.S.A. 52:32-44) effective September 1,2004, all business organizations that conduct business with a New Jersey government agency are required to be registered with the State of New Jersey. Bidders and their subcontractors must submit proof that at the time of the Bid they are registered with the New Jersey Department of Treasury, Division of Revenue by submitting a copy of their Business Registration Certificate prior to Contract award. Pursuant to N.J.S.A. 10:5 31 et seq., bidders are required to comply with the requirements of P.L. 1975 c. 127, NJAC 17:27. Each Bidder must submit with his bid an "Ownership Disclosure Statement" and "Non-Collusion Affidavit" on the forms included in the Contract DocuA-rnents. Bidders and their subcontractors of any tier must comply with all applicable provisions of the Public Works Contractor Registration Act, P.L. 1999, c. 238 (N.J.S.A. 34:11-56.48) and the New Jersey Prevailing Wage Act (N.J.S.A. 34:11-56.25). Bidders will be subject to penalties for falsification in accordance with the statutory provisions contained in N.J.S.A. 40A:11-33 to 34 ("Local Public Contract Law").
