Bernard Intersection Improvements The Bidder hereby certifies that he has examined the contract form and specifications for the project CLI-CR-12-1.419 ANTIOCH / BERNARD INTERSECTION IMPROVEMENTS (OPWC CJ25Z) and is familiar with the liquidated damage features thereof. Contractor agrees to maintain a construction schedule in accordance with these specifications such that the roadway is completed on or before November 4, 2024. The work covered by this completion guarantee shall include only those items listed for comparison of bids. The contractor hereby agrees that the said owner shall be and are hereby authorized to deduct and retain out of the moneys which may be due or become due to the said contractor, under this agreement, as damages for the non-completion of the work aforesaid within the time hereinbefore stipulated for its completion or within such further time as in accordance with the provision of this agreement shall be fixed or allowed for such performances or completion, the sum of $300 per day for contract amounts from $0 to $200,000, and $600 per day for all contracts over $200,000 for each and every day the time employed upon said work may exceed the time stipulated for its completion, or such stipulated time as the same may be increased, as hereinbefore provided, which said sum of $300 per day for contract amounts from $0 to $200,000 and $600 per day for all contracts over $200,000 is hereby, in view of the difficulty of estimating such damages, agreed upon, fixed and determined by the parties hereto as the liquidated damages that the owner will suffer by reason of such default and not by way of penalty. Each bidder is required to furnish with its proposal, a Bid Guaranty and Contract Bond in accordance with Section 153.54 of the Ohio Revised Code. Bid security furnished in Bond form, shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide said surety. All contractors and subcontractors involved with the project will to the extent practicable, use Ohio products, materials, services, and labor in the implementation of their project. Additionally, contractor compliance with the equal employment requirements of Ohio Administrative Code Chapter 123 is required. Bidders must comply with the prevailing wage rates on Public Improvements in Clinton County, Clark Township as determined by the Ohio Department of Commerce, Bureau of Wage and Hour Administration, 614.644.2239. The Board of County Commissioners reserves the right to accept the lowest and best bid, reject any and all bids, and to waive any irregularities in bids.
