Question Deadline 10/09/2023 The City reserves the right to evaluate all bids, waive any technical or informalities, reject any and/or bids and proposals, and further specifically reserves the right to make the award and/or awards in the best interest of the City. All bidders must submit with their proposal, contractors license number and a copy of the license. State law Ala. Code §34-8-8(b) requires all bids to be rejected which do not contain the contractors current license number. Evidence of this license shall be documented on the outside of the sealed bid. All bidders shall possess all other licenses and permits required by applicable law, rule or regulation for the performance of the work. It is the intent of the City of Opelika to accept bids on furnishing all material, labor, equipment, and supervision in order to provide planting, landscaping, and maintenance around the Opelika Police Department. It is the intent of the City that the job be complete at the conclusion of the work, and nothing contained in the “Scope of Work” shall limit the contractor’s responsibility to less than furnishing the complete job of the quality and workmanship hereafter specified and intended. All bidders shall be qualified and be properly licensed contractors in the State of Alabama at the time the bids are submitted. The successful bidder, whether a resident or nonresident, shall be required to comply with all licensing and permit laws of the City of Opelika, Alabama, and the State of Alabama. A certified check or Bid Bond payable to the City of Opelika, Alabama in an amount not less than five percent (5%) of the amount of the bid, but in no event more than $10,000.00 must accompany the bidder's sealed proposal - refer also to Instructions to Bidders. Performance and statutory labor and material payment bonds for the full contract sum will be required of the successful bidder at the signing of the Contract Any person, firm, or corporation entering into a contract with the City for the repair or construction of any public building, public work, highways, or bridges shall provide a performance bond equal to 100 percent of the contract price. Such bond shall be from an accredited insurance company as approved by the City of Opelika Purchasing Agent Labor and Material Bond shall be submitted by successful vendor for a construction project as surety, payable to the City of Opelika of not less than 50 percent of the contract price, with the obligation that such contractor shall promptly make payments to all persons supplying him/her with labor, materials, or supplies for the payment of reasonable attorneys’ fees incurred by successful claimants or plaintiffs in civil actions on said bond. Bonds are not required on contracts of less than $10,000.00.
