The successful bidder may be required to furnish a contract performance bond and a labor and materials payment bonds in the penal amount of one hundred percent (100%) of the contract price as originally bid or subsequently modified. Bidders on this work will be required to comply with the President's Executive Order Nos. 11246 (Equal Employment) as amended, 11518 (Small Business Concerns), and 11625 (MBE) as amended. The requirements for bidders and contractors under these orders are explained in the specifications. Bidders on this work will be required to comply with Title 40 CFR 33.240 and Executive Order 12138 (WBE). The requirements for bidders and contractors under this regulation that concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women's Business Enterprises (WBE) are explained in the specifications. Project goals are 4% for MBE and 2% for WBE. HOME-ARP funds, Section 3 requirements apply to this project. Section 3 qualified businesses are encouraged to bid on this project and all bidding contractors must make an effort to solicit bids from Section 3 qualified businesses. The successful bidder-- including any contractors on the project, must be registered in SAM (System for Award Management). Instruction on how to register with SAM can be found in each Bid Package in the "Scope of Work Inclusions" section under "Project Specific Notes".
