Bids shall be submitted in a sealed envelope marked "Sealed Bid, WAN Expansion" prior to the deadline or brought to the bid opening. Bidders must submit a hard copy of their bid and any required forms, AND an electronic version of the bid response (including any required forms) on a USB flash drive in a sealed envelope, with their firm's name and address clearly indicated on the envelope. Respondents choosing not to attend in so doing acknowledge their understanding that they were offered and voluntarily declined the opportunity. Any questions should be directed to Seth Slater, seth.slater@nacs.kl2.in- .us, no later than 12:00PM on August 16. 2023. Bidders will be required to file, with their bids, a certified check made payable to the Northwest Allen County Schools or a Bid Bond for an amount not less than five percent (5%) of their maximum bid or bids. Should a successful bidder withdraw its bid, or fall to execute a satisfactoiy Contract, Northwest Allen County Schools may then declare the bid deposit or bia bond to be forfeited as liquidated damages. Each successful bidder shall be required to furnish an approved Performance Bond and a Labor and Materials Payment Bond which cover faithful performance of the contract and the payment of all obligations arising thereunder. A Maintenance Bond shall also be required. Said bonds shall remain in full force and effect for twelve months from the substantial completion of the Work. The Northwest Allen County Schools Board of Trustees reserves the right to waive formalities in bidding, to reject any or all bids, and to let separate contracts or as a whole, without assigning any reason for its action in tne premises, using its discretion to determine what action will be in the best interest of Northwest Allen County Schools. The contract will be awarded to the lowest responsive and responsible bidder complying with the conditions for bidding, provided the bid is reasonable and it Is to the best interest of the Owner to accept it. The Owner reserves the right to reject the bid of any or all bidder in accordance with Indiana Code 36-1-12. Bids not reaching said office by the established deadline will not be opened or considered.
