McElroy AIA, N'CARB, and at the Noxubee County School District office. Contract Provisions are based on guidance from the Mississippi Attorney General's Office as it relates to contracts with public entities in Mississippi and from the Mississippi Department of Education as it relates to the Elementary and Secondary School Emergency Relief Fund (ESSER) and other federal funding guidelines. Certain provisions are not subject to waiver or modification by the Owner. All bids must be accompanied by bid security equal to five percent (5%) of the sum of the base bid and all alternates, and must be in the form of a certified check, cashier's check or a Bid Bond written by a company licensed to do business in Mississippi. The successful bidder will be allowed 365 calendar days from the date of issuance of Notice to Proceed to complete the project. Liquidated damages will be assessed at $500.00 per day for each calendar day the work is not substantially complete.
