Project Description: This project includes furnishing all labor, equipment, materials, and incidentals required to construct approximately 6,000 linear feet of crushed limestone surface nature trail, boardwalk, and a new rest area to be constructed at the existing parking lot for the Heartland Trail with restrooms and associated landscape and hardscape. Said bid guaranty shall be in the form of either a bond in the full amount of the BID or a certified check, cashier's check, or letter of credit in an amount equal to ten percent (10%) of the BID in accordance with Section 153.54 of the Ohio Revised Code. the Village reserves the right BD-1 to reject the bids of any bidder if the Village believes it would not be in the best interest of the Village to make the award of that bid; whether because the bid is not responsive, or the bidder is unqualified or of doubtful financial ability or fails to meet any other pertinent standards or criteria established by the Village. A bid guaranty filed in the form of a bond shall be in the form of the BOND included in these BIDDING DOCUMENTS. A bid guaranty filed in the form of a certified check, cashier's check, or letter of credit shall be conditioned to provide that if the bid is accepted, the BIDDER will, after the award of the contract, enter into a proper contract in accordance with the bid, plans, details, specifications, and bills of material. If the BIDDER enters into the contract, the BIDDER shall, at the time he/she enters into the contract, file a bond for the amount of the contract to indemnify the OWNER against all damage suffered by failure to perform the contract according to its provisions and in accordance with the plans, details, specifications, and bills of material. Each bidder is required to furnish with his proposal a Bid Guarantee and Contract Bond in accordance to Section 153.54 of the Ohio Revised Code. The bid bond may be in the form of a bid guarantee, letter of credit for 100% of the project, or certified check from a solvent bank or cash in the amount of 10% of the total bid submitted. Bid security furnished in Bond form shall be issued by a Surety Company or Corporation licensed in the State of Ohio to provide such surety. Checks should be made payable to the Village of Marshallville. Bid guarantees/bid bonds will be returned to all unsuccessful bidders. The owner intends and requires that this project be completed no later than November 22, 2023
