General 1. The General Contractor shall be subject to non-payment of items for noncompliance with contract requirements for maintenance and protection of facilities, restoration of surfaces and final cleaning, as outlined in Supplementary Conditions of this Contract Document. 2. This contract shall include all the work set forth in the and specifications required to complete the improvements described. The descriptive narrative prepared for the contract has been structured to define the general work required. There is no intention, either implied or otherwise, that these narratives accurately or completely list all items of work to be undertaken as part of the contract. Any necessary work which is not specifically described in the contract documents shall be included in the contract. Where used herein, the words included or including shall mean including but not restricted to. The contract shall include all labor, material, equipment, and other expenses required to perform the work specified. Work shall be performed in accordance with all applicable permits. 3. The work will be in close proximity to existing utilities. The Contractor shall notify all utilities and/or the Town of Batavia Engineer at least three days prior to starting the work. The Contractor shall fully familiarize himself with all existing utilities and facilities. The Contractor shall protect existing facilities. The Contractor shall utilize every precaution to protect such structures and utilities from any and all damage, with the understanding that all damage shall be repaired or replaced as directed by the Engineer at no additional cost to the Owner. This project includes the remediation of mold based on contractor's experience, applicable laws and regulations and review of the mold inspection laboratory results included with the bid documents, removal of insulation at the roof level throughout the heated portion of the garage facility (except offices), and installation of new insulation. All bids shall be binding for a period of sixty (60) days after the bid opening date. The Town of Batavia reserves the right to reject any and all bids and to waive any informalities therein.
