The term of the contracts will be for one (1) year or the expenditure of the maximum contract value ($5,797,275.00), whichever comes first. Provided however, that if a work order is issued by LACDA prior to the expiration of the annual contract period, the contract term shall be automatically extended solely to allow the original scope of such work order to be completed. There is no minimum contract value. Bids must include all completed forms contained in Appendix B Federal Required Forms. Failure to complete these forms may result in a determination that the bidder is non-responsive. Failure to submit accurate and complete responses may result in a determination that the bidder is non-responsible. Bidders shall guarantee their bid for a minimum of 270 days. Bidders must submit separate bids for each JOC Contract number. A Job Order Contract (hereinafter called JOC) is a competitively bid, firm fixed priced indefinite quantity contract pursuant to which the Contractor may perform an ongoing series of individual projects at different locations throughout the County of Los Angeles. Work Orders issued through this JOC contract may include projects to remediate lead-based paint hazards from residential dwellings of five (5) or more units at a time, under the guidelines of the U.S. Department of Housing and Urban Developments (HUD) Lead-Based Paint Hazard Reduction Grant Program. They may also include a collection of detailed repair remodeling, refurbishment, alteration and other construction tasks and specifications which all have established unit prices. The Contractor or approved Subcontractor shall possess all necessary certifications and licenses to perform all lead-based paint hazard remediation activities as required by all applicable local, state, and federal regulations. Ordering is accomplished by the issuance of a Work Order against the Contract. The work of this Contract will be set forth in the Detailed Scope of Work referenced in the individual Work Orders. The Gordian JOC SolutionTM includes Gordians proprietary JOC Software and JOC Applications, construction cost data, and Construction Task Catalog which shall be used by the Contractor solely for the purpose of fulfilling its obligations under this Contract, including the preparation and submission of Job Order Proposals, Price Proposals, subcontractor lists, and other requirements specified by the Owner. Details on the JOC program are available in this solicitation package under Work Ordering Procedure. For Bidders who are new to the JOC process, a training workshop will be scheduled by the Gordian account manager at a later date. No mailed, emailed, in-person, oral, facsimile, or telephonic proposals or modifications will be considered unless specified. Bids received after the scheduled deadline will be returned unopened. Bidders, who, upon request, receive the Invitation for Bids package and do not wish to submit a bid should reply with a letter of No Bid by the submission due date. The contractor agrees to be bound by applicable federal, state, and local laws, regulations, and directives as they pertain to the performance of these JOC contracts. Under this procurement, all federal requirements will apply to JOC Nos 87, 88, 89, and 90. In submitting a bid, each Bidder thereby agrees that, if awarded a contract, it shall execute a standard LACDA construction contract, a sample of which is included as Appendix A in the IFB package for reference. The LACDA shall not award a contract to or be obligated to execute a contract with any Bidder who refuses to execute said standard LACDAs contract. The LACDA reserves the right to reject any and all bids. This IFB is not a contract or commitment of any kind. The LACDA is not liable for costs incurred by Bidders in the preparation of their respective bids in response to this IFB. The LACDA reserves the right to issue supplementary information or guidelines related to this IFB. Notwithstanding any other provisions herein, the LACDA reserves the right in its sole discretion to waive minor technical deficiencies in the Bids. In accordance with the Civil Rights Act of 1964, Americans with Disabilities Act of 1990, Age Discrimination Act of 1975 and Section 504 of the Rehabilitation Act of 1973, it is the policy of the LACDA to assure equal opportunity to all persons, in the award and performance of any contract, without regard to race, color, sex, religion, national origin, ancestry, age, marital status, or disability. Some of the applicable requirements, regulations, ordinances, and statutes that will be rigidly enforced in the contract include, but are not limited to: Section 3 of the Housing and Development Act of 1968 Child Support Compliance Program (County Code Chapter 2.200) Defaulted Property Tax Reduction Program (Reference: County Code Chapter 2.206) Federal Labor Standards Provision B - General Building Contractor - California Contractors State License Board Current and Active California Department of Industrial Relations Registration Insurances (Please refer to the Sample LACDA Construction Contract for required values and additional requirements). General Liability Insurance with Additional Insured Endorsement (shall include Completed Operations and be on a primary and non-contributory basis) Workers Compensation Liability Insurance, shall be Statutory and include Employers liability, and a waiver of subrogation Automobile Liability Insurance, coverage shall include owned, hired, non-owned, or any auto 5% Bid Bond Required for each bid 100% Performance and 100% Payment Bonds for each
