resurfacing of streets, sidewalks and related construction work on various streets in the City. The Contractor shall, pursuant to the terms of this AGREEMENT, provide all the supplies, materials, and equipment, and perform all the labor, services and supervision necessary and proper for (hereinfter called the "Project") in the City of Worcester, Massachusetts, and to accomplish any and all work incidental thereto. Bid Security (5% of Total Bid) A performance bond and a labor and materials payment bond, each in the amount of the contract sum, must be furnished by the general contractor as stated in the bid form. Such bonds must be on the forms contained in the bid documents and must be executed and delivered to the Owner at the time of execution of the contract. Each attorney-in-fact who executes such a bond on behalf of the surety must affix thereto a certified and current copy of his power of attorney The Owner has established goals for the participation of minority and women contractors and subcontractors on all City projects. In furtherance thereof, the City of Worcester's Supplemental Equal Employment Opportunity AntiDiscrimination and Affirmative Action Program is included in the Bidding Documents, and all bidders shall comply with the requirements set forth therein All questions must be referred in writing to Chris Gagliastro via e-mail at gagliastroc@worcesterma.gov The Owner reserves the right to reject any and all general bids which contains erasures, alterations, additions, errors or irregularities of any kind, or which contains proposed prices for any class or item of work which are, in the judgment of the Owner, substantially less or more than the actual cost to complete the work; provided, however, that the Owner reserves the right to waive any and all informalities as to form. Matters as to substance shall not be waived.
