Each Bidder shall agree not to withdraw a Bid Proposal for a period of sixty (60) calendar days after the date for receipt of bids. The Board reserves the right to reject any or all bids received and to waive any formalities in regard thereto. In addition, the Board reserves the right to evaluate bids on any basis determined by the Board to be in the best interest of the Board and to consider alternate bids if the low bidder(s) do not meet the specifications or are otherwise to be unqualified. Familial Disclosure Statement: A sworn and notarized statement in compliance with Michigan Compiled Laws, MCL.380.1267, disclosing any familial relationship existing between the Bidder, or any employee of the Bidder, and any member of the Board of Education of the School District or the Superintendent of the School District, must accompany each Bid Proposal. The Iran Economic Sanctions Act: A sworn and notarized statement in compliance with Michigan Public Act No. 517 of 2012 must accompany each Bid Proposal. The Owner will not accept a bid that does not include all of these forms and statements. Bidders shall provide a Bid Security certified check or acceptable bid bond payable to St. Clair County RESA, in an amount equal to five percent (5%) of the total bid. A Performance Bond and a Labor and Material Payment Bond will be required for bids in excess of $50,000 each in the amount of one hundred percent (100%) of the contract amount. The cost of such bonds shall be included in the Bid Proposal. The Owner reserves the right to reject any or all Bid Proposals, either in whole or in part, and to waive any informalities and irregularities in the Bid Proposals and in the bidding. The undersigned agrees to commence contracts, submittals, etc. on August 22, 2023, with actual physical work commencing on January 5, 2024 and fully complete the total project by May 6, 2024.
