A satisfactory Bid Bond executed by the Bidder or an acceptable surety in an amount equal to 5% of the bid shall be submitted with each bid. The successful Bidder will be required to furnish and pay for a satisfactory 100% Performance Bond and Labor and Material Payment Bond in the amount of the contract price. Each Bidder must ensure that no employees and applicants for employment are discriminated against because of race, creed, color, sex, or national origin. Bids may not be withdrawn for a period of 30 days without the consent of the Owner Marshall County Schools reserves the right to reject any and all bids, to waive all formalities, and to make selections from the bids that are solely in the best interest of the school system. Marshall County Schools will suffer loss if the project is not completed within the Contract Time. Therefore, as liquidated damages, and not as a penalty, the Contractor shall be liable for such damages at the rate of $750.00 per calendar day for unexcused delays beyond the date of Substantial Completion.
