This work consists of furnishing all necessary design, supervision, labor, tools, materials, and equipment to perform all work necessary to install the helical pile foundations, per the specifications described herein, and as shown on the drawings. The Contractor shall install a helical pile foundation that will develop the load capacities as detailed on the drawings. The Town reserves the right to reject any and all bids or any part thereof, or to accept any bids or any part thereof, to waive any irregularity, informality or technicality in any bid, or to withhold the award to the extent permitted by law. The Town further reserves the right to advertise for new bids if, in the judgment of the Town, it isin the best interests of the Town. The Bidder agreesthat he/she may not withdraw his/her bid after accepted by the Town and prior to execution of the Contract by the successful Bidder. The Bidder further agreesthat if he/she defaultsin executing the required Contract Agreement and/or fails to submit the required Performance Bond, Payment Bond, Insurance Certificate(s), or executed Contract Agreement to the Town by the Town's specified date, the proceeds of his/her proposal guarantee accompanying his/her Bidder's Proposal, be it cash, check or bond may be forfeited to the Town of Oro Valley, subject to the law, and this Bidder's Proposal, acceptance and the Award of the Contract may be considered null and void. Accompanying this Bidder's Proposal is cash, a cashier's check, certified check or Bidder's Bond payable to the Town of Oro Valley in the amount of dollars which is equal to at least ten percent (10%) of the total amount of the bid
