Pedestrian Crossings @ Louisiana & New Hampshire, 11th & New Hampshire, and sidewalk on Maine from 6th to 4th (east) & Kentucky from 12th to 19th The anticipated start date is July 25th , 2023- August 7th , 2023 with a substantial completi on of March 1st, 2024 and final completion date of March 22nd , 2024. AUTHORITY AND DUTY OF THE ENGINEER. It is mutually agreed, by and between the parties to this contract, that the Engineer shall supervise all work included herein. In order to prevent delays and disputes and to discourage litigation, it is further agreed by and between the parties to this contract that the Engineer shall in all cases determine the amounts and quantities of the several kinds of work which are to be paid for under this contract; that the Engineer shall determine all questions in relation to said work and the construction thereof; that the Engineer shall in all cases decide every question which may arise relative to the execution of this contract on the part of said Contractor; that the decisions and findings of theEngineer shall be the conditions precedent to the right, of the parties hereto; to any action on the contract, and to any rights of the Contractor to receive any money under this contract. Should the Engineer render any decision or give any direction which, in the opinion of either party hereto, is not in accordance with the meaning and intent of this contract, either party may file with the Engineer, within thirty (30) days, their written objection to the decision or direction so rendered. It is the intent of this agreement that there shall be no delay in the execution of the work, and the decision or directions of the Engineer as rendered shall be promptly carried out. Any claim arising therefrom shall be thereafter adjusted by any appropriate means.
