The Town of Acton invites sealed bids for the removal of the existing boardwalk and foundations, installation of proposed helical pile foundations in the identical location of existing foundations, replacement of the existing boardwalk and framing with new materials as specified in the identical layout and location as the existing boardwalk, approach ramp and finish work, associated work and all materials necessary to complete the work located at NARA Park, 25 Ledge Rock Way. All bids for this project are subject to the provisions of Massachusetts General Laws Chapter 30, Section 39M, as amended and subject to all applicable bidding laws thereto. The minimum wage to be paid for all labor is established in a schedule issued by the Commissioner of Labor and Industries and the weekly payroll record submittal requirements under the provisions of Massachusetts General Laws, Chapter 149, Section 26 through 27D inclusive. Said schedule being made a part of the Contract Documents and is included therein. Materials, equipment and supplies to be used on this project are exempt from sales tax to the extent provided by M.G.L. Chapter 64H, Section 6(f). Each Bid must be accompanied by a bid security consisting of a BID BOND, or, CERTIFIED CHECK issued by a responsible bank or trust company in the amount of 5% of the bid price. The successful bidder will be required to provide a Performance Bond in an amount equal to 100 percent of the total amount of the bid, with a surety company qualified to do business in the Commonwealth of Massachusetts, will be required for the faithful performance of the Contract, as well as a Labor and Materials Payment Bond in an amount equal to 100 percent of the total amount of the bid. The Contractor is responsible for paying for these bonds. Cost of all bonds must be included in the bid submittal price. Selection of the contractor will be based upon bidder qualifications, including evidence of past performance in similar projects, and bid price. The contract will be awarded to the bidder deemed by the awarding authority to be the lowest responsible and eligible bidder. The bidder agrees that its bid shall be good and may not be withdrawn for a period of forty-five (45) days, Saturdays, Sundays and legal holidays excluded, after the opening of the bids.
