Apparent Low Bidder: Within ten (10) business days after receipt of the Letter of Intent from DAS/CS, the Apparent Low Bidder shall substitute for the certified check or bid bond accompanying its bid an executed performance bond, in the amount not less than 100 percent of the contract price, conditioned upon the faithful performance of the contract, and having as surety thereto such surety company or companies satisfactory to the Commissioner and as are authorized to transact business in this State. This bond is to be furnished pursuant to C.G.S. 49-41, as revised. See Section 00 92 10 Additional Forms of this Project Manual for a template. The Commissioner of the Connecticut Department of Administrative Services reserves the right to do any of the following without liability, including but not limited to: (a) waive technical defects in the bid proposal as he or she deems best for the interest of the State; (b) negotiate with a contractor in accordance with Connecticut General Statutes Section 4b-91; (c) reject any or all bids; (d) cancel the award or execution of any contract prior to the issuance of the "Notice To Proceed"; and (e) advertise for new bids.
