Questions must be submitted on or before 12/07/2018 4:00 PM Expected Contract Value $75,000-$150,000 Bid bond or certified check for 10% of the total base bid payable to "Borough of Lititz" (Owner) shall accompany each proposal, to be forfeited in liquidated damages should the bidder default in execution of the contract within 180 days after award of same. Bids may not be withdrawn within 60 days after bid opening. Lititz Borough reserves the right to waive irregularities in, or reject any and all bids. The Owner shall award the contract to the lowest responsible and responsive bidder or reject all bids within sixty (60) days from the date of the bid opening; provided, however, if the award is delayed by the required approval of another governmental agency, the sale of bonds, easement acquisition or the award of a grant, the Owner shall reject all bids or award the contract to the lowest responsible and responsive bidder within one-hundred twenty (120) days from the date of the bid opening. In accordance with the Pennsylvania Antibid-Rigging Act, 73 P.S. Section 1611 et seq., a Non-Collusion Affidavit must be submitted. This project will include prevailing wage determinations as defined by the United States Department of Labor. Bidders on this Work will be required to comply with the Provisions of the Pennsylvania Prevailing Wage Act 442. The Prevailing Wage Scale/Schedule is included in the Specifications. Failure to submit a bid guaranty; and if a Bid Bond is used as a Bid Guaranty, failure to submit a completed (all signatures and seals) Bid Bond Form will result in the rejection of the Bid Proposal as non-responsive. After the Bid opening, Bids may be withdrawn only by complying with Commonwealth of Pennsylvania laws and regulations. A summary of such laws and regulations is given in the Instructions to Bidders. It is a requirement of this Contract that at least 50% of the Work be performed by prime Bidder's own work force, not by subcontractor(s). It is a requirement of this Contract that Bidders shall have a minimum five (5) year, five (5) project documented experience in the type of Work required by this Project. The cost of each project included in the Bidder's questionnaire must be in excess of $250,000 in order to be considered project experience. Bidders, subcontractors, their workers and any persons providing labor and products to the Project shall be persons lawfully permitted to work in the United States and the Commonwealth of Pennsylvania. As a precondition of being awarded a Contract, Successful Bidder, and its subcontractor(s) are required, to provide confirmation of compliance with Act 127 of 2012, the "Public Works Employment Verification Act". In accordance with the Pennsylvania Antibid-Rigging Act, 73 P.S. Section 1611 et seq., a NonCollusion Affidavit must be submitted. Effective January 1, 2009, all responses to this procurement opportunity are subject to the Pennsylvania Right-to-Know Law, 65 P.S. 67.101 et seq., (Act 3 of 2008). The Right-to-Know Law permits any requestor to inspect and/or copy any record prepared and maintained or received in the course of the operation of a public office or agency that is not subject to the enumerated exceptions under the law. If your response to the Bid opportunity contains a trade secret or confidential proprietary information, you must include with your response a separate signed written statement to that effect. Should your response become the subject of a Pennsylvania Right-to-Know Law request, you will be notified by the Owner to identify all trade secrets or confidential and proprietary information. The agency will then determine whether the claimed trade secret or confidential and proprietary information is subject to disclosure. The Borough of Lititz hereby reserves the right, which is understood and agreed to by all Bidders, to reject any or all Bids and to waive any omissions, errors, or irregularities in any Bid.
